The rules for using this site

What this page is

These are the rules for using this website. They are short on purpose. We are an advocacy organization publishing policy work, not a store, and most of what a normal terms page contains does not apply to us.

By using the site you are agreeing to what is below. If you do not agree, do not use it.

Who we are

The Personalized Health Association is a national 501(c)(4) social welfare organization. We advocate on federal health policy: a clear FDA pathway for adult stem cell and regenerative medicine, modernized rules for physician-led clinical research, permanent telemedicine prescribing authority, and modern standards of care for men's health and hormonal medicine.

What this site is for

We publish what we are working on. Our policy positions, our papers and comments, what we think proposed rules would do, who is involved, and where we will be.

That is the whole purpose. It is a record of an advocacy organization's work, made public so that physicians, clinic operators, researchers, industry and patients can see it and respond to it.

This is not medical advice

Nothing on this site is medical advice.

We write about treatments, medications, clinical research and standards of care because those are the subjects of the policies we work on. Describing a policy about a treatment is not the same as recommending the treatment, and we are not recommending it.

• We do not diagnose, treat or prescribe.
• Reading this site does not make you our patient and does not create a doctor-patient relationship with anyone.
• Nobody at PHA is acting as your physician, and no article here has been written with your situation in mind.
• If you have a medical question, ask a licensed clinician who knows your history.
• If this is an emergency, call your local emergency number. Do not send us a message.

We say this plainly because our subject matter invites the opposite assumption. A page about hormone therapy policy is not guidance about hormone therapy.

It is not legal or regulatory advice either

We write about statutes, agency rules, dockets and legislative proposals. We do that as an advocate arguing a position, not as anyone's counsel.

If you are a physician, a clinic operator, a compounder or a manufacturer trying to work out what a rule requires of you, talk to your own lawyer or regulatory adviser. What we publish reflects the position we are arguing for. It is not a compliance opinion and it should not be relied on as one.

We try to get it right, and policy moves

We source what we publish. Facts and numbers get a link to where they came from, so you can check them yourself. If we get something wrong, tell us and we will fix it.

Even so, two things are true:

• Policy changes. A rule can be proposed, revised, withdrawn or struck down between the day we write about it and the day you read it. A page describing the state of a docket is accurate as of its date, and its date is on it.
• We can be wrong. If you find something incorrect, tell us through the contact form. We would rather fix it than defend it.

We do not promise that every page is current. We do promise that we will not knowingly leave something up that we know is wrong.

Links to other places

We link to agency dockets, statutes, news coverage, research and other organizations' work.

We do not control any of it. A link is not an endorsement of everything on the other end, and it is not a statement that the other site's privacy practices are like ours. Once you click through, you are on their site under their rules.

What you can do with what we publish

Read it. Quote it. Send it to people. Cite it in your own work. That is why it is public.

Specifically, you are welcome to:

• read, print and save pages for your own use
• quote us, with attribution to the Personalized Health Association and a link where you can
• share links anywhere
• use our published policy positions in your own comments, submissions and advocacy, including in filings with an agency

You should not:

• republish whole articles or papers as though they were yours, or strip our name off them
• change what we said and keep our name on it
• sell our content, or put it behind your own paywall
• scrape the site at a volume that degrades it for other people, or use automated tools to harvest content wholesale
• use our content to train a machine learning model without asking us first
• use the site to break the law, to send unsolicited commercial messages to addresses found here, or to attack the site or the people using it
• try to get into any part of the site that is not public

If you want to do something that is not on either list, ask. The answer is usually yes.

Our name and logo

"Personalized Health Association" and "PHA," our logo, and the look of this site belong to us. Using our name to describe us, quote us or link to us is fine. Using our name or logo in a way that suggests we endorse you, your product, your clinic or your position is not.

Other organizations' names and marks that appear here belong to them.

Where our pictures come from

Some of the photographs on this site are licensed through Pexels. The Pexels license does not require us to credit anyone. We are saying it here anyway, because it costs nothing to say where something came from.

Those photographs are by the Pexels contributors ramazphotos, kelly and rperucho. Those are the names they publish under, which is what we can actually verify, so that is what we print.

Most of the rest of the imagery on this site was generated with AI tools rather than photographed. That covers the pictures at the top of most pages, and the header images on our articles. They are there to set a scene, not to document one.

So please take them for what they are. Nobody in a generated picture is a real person you could go and find. The labs, the offices, the hearing rooms and the paperwork in them are not real ones either. No specific place, and no specific document. When an image like that sits beside a piece about a rule or a hearing, it is illustrating the subject. It is not showing you the thing itself.

There are real photographs on this site too, of things that actually happened. Both kinds are here, and we would rather say so in one place than put a label under every picture.

Anything you send us

If you send us a message, a comment, a document or a suggestion, two things happen.

We can use it. You are giving us permission to read it, act on it, and use the ideas in it in our advocacy work, without owing you anything for it. If we want to quote you publicly by name, we will ask first.

You are confirming it is yours to send. Do not send us anything you do not have the right to send us, and do not send us anything confidential. This is not a secure channel and we are not going to treat an unsolicited message as confidential just because it says so at the bottom.

And, from the privacy policy but worth repeating here: please do not send us your medical information. We are not a clinic, we cannot help with it, and we would rather not hold it.

No warranty

We provide this site as it is. We do not promise that it will always be available, that it will be free of errors, or that it will meet any particular need you have.

To the extent the law allows, we are not making any implied promises about merchantability, fitness for a particular purpose, or non-infringement.

What we are responsible for

To the extent the law allows, PHA is not liable for indirect, incidental, special or consequential losses arising from your use of this site. That includes lost profits, lost data, and losses from relying on something you read here.

Some places do not allow those limits, and where that is true, this section applies only as far as it legally can.

Nothing here limits our liability for anything that cannot be limited by law.

If one part does not hold up

If a court decides some part of these terms cannot be enforced, the rest still applies. The unenforceable part gets narrowed to whatever version of it is enforceable, rather than taking the whole document down with it.

Changes to these terms

We may update this page. When we do, we will change the date at the top. If a change is significant we will say so on the site rather than editing quietly.

Continuing to use the site after a change means you accept the updated version.
